By accessing and using HVAC Recruit's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Services Provided

HVAC Recruit provides recruitment and staffing services specifically for the HVAC industry, including:

• Candidate sourcing and screening
• Job placement services
• Career consultation and guidance
• Talent matching and assessment

3. User Obligations

As a user of our services, you agree to:

• Provide accurate and complete information
• Maintain the confidentiality of your account credentials
• Use our services in compliance with all applicable laws
• Not misuse or abuse our platform or services
• Respect the intellectual property rights of HVAC Recruit and third parties

4. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms of Service by reference. By using our services, you consent to the collection and use of your information as outlined in our Privacy Policy.

5. Placement Guarantee

HVAC Recruit offers a 90-day placement guarantee for all successful placements, subject to the following conditions:

• The candidate must be terminated for performance-related issues within 90 days
• The client must provide written notice within 5 business days of termination
• A replacement candidate will be provided at no additional fee
• This guarantee does not apply to terminations due to layoffs, restructuring, or misconduct

6. Payment Terms

For corporate clients:

• Placement fees are due within 30 days of candidate start date
• Late payments may incur interest charges of 1.5% per month
• Disputed invoices must be raised within 10 business days
• All fees are non-refundable except as specified in our guarantee policy

7. Limitation of Liability

HVAC Recruit's liability is limited to the amount of fees paid for the specific service in question. We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or business interruption, regardless of the cause of action.

8. Intellectual Property

All content, trademarks, and other intellectual property on our platform remain the property of HVAC Recruit or our licensors. Users may not reproduce, distribute, or create derivative works without explicit written permission.

9. Termination

Either party may terminate this agreement at any time with written notice. Upon termination, all outstanding obligations must be fulfilled, and access to our services will be discontinued.

10. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, with proceedings held in South Florida.

11. Modifications

HVAC Recruit reserves the right to modify these terms at any time. Users will be notified of material changes, and continued use of our services constitutes acceptance of the modified terms.

12. Governing Law

These Terms of Service are governed by the laws of the State of Florida, without regard to conflict of law principles.
